Welcome to the official website (globalfengshui.org) of the Global Feng Shui Association (hereinafter "the Association," "we," "us," or "our"), an international non-profit organization registered in Canada. Before using the services of the Association, please ensure you carefully read and fully understand these Terms of Service (hereinafter "these Terms"). These Terms constitute a legally binding agreement between you (hereinafter "User" or "you") and the Association regarding your use of this website and related services.

By accessing this website, registering an account, or using any services provided by the Association, you signify that you have read, understood, and agree to be bound by all contents of these Terms, and you represent that you have the legal capacity to enter into this agreement. If you do not agree with any part of these Terms, or if you do not have the requisite legal capacity, please cease using our services immediately.

1. Description of Services

The Association, through its official website and other possible online or offline channels, provides its global public and members with services including, but not limited to, the following, consistent with its mission:

  • Publishing Association news, industry insights, and international academic research findings;
  • Providing international educational courses, professional training programs, and learning materials related to Feng Shui and I Ching studies;
  • Organizing international online and offline academic seminars, lectures, multicultural exchange events, and other activities;
  • Offering global member registration, management, and exclusive services;
  • Implementing professional certification and verification services for individuals and organizations, adhering to international standards;
  • Providing other information and support services related to the Association's international mission and multicultural objectives.

The Association reserves the right to modify, suspend, or terminate any part or all of its services at any time, at its sole discretion, and will make reasonable efforts to provide advance notice where practicable.

2. User Conduct

When using the Association's services, Users must comply with all applicable laws and regulations of Canada (the Association's place of registration), as well as the laws and regulations of the User's own jurisdiction and relevant international conventions. Users undertake not to engage in any of the following activities:

  1. Publishing, transmitting, or disseminating any content that is unlawful, threatening, defamatory, libelous, obscene, pornographic, racially or culturally discriminatory, invasive of another's privacy or intellectual property rights, or otherwise objectionable under generally accepted international standards;
  2. Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with any person or entity;
  3. Interfering with or disrupting the normal operation of this website, or the servers or networks connected to this website, or disobeying any reasonable requirements, procedures, policies, or regulations of networks connected to the Service;
  4. Attempting to gain unauthorized access to any part of this website, other user accounts, or any computer systems or networks connected to this website;
  5. Collecting or storing personal information of other users without their express consent, or in violation of applicable privacy laws (such as Canada's PIPEDA and relevant local data protection regulations);
  6. Using any services or content provided by the Association for any commercial purpose without the prior express written permission of the Association;
  7. Engaging in any other conduct that could damage the international reputation, legitimate interests, or normal operations of the Association.

The Association reserves the right to monitor User conduct and to take appropriate action against Users who violate these Terms, including but not limited to issuing warnings, restricting access, suspending services, terminating accounts, and pursuing legal remedies available under applicable law.

3. Intellectual Property Rights

This website and all its content, including but not limited to text, graphics, images, logos, audio clips, video clips, data compilations, software, and their design, selection, and arrangement (collectively, "Website Content"), are the property of the Association or its content suppliers and are protected by Canadian and international copyright, trademark, and other intellectual property laws.

Without the prior express written authorization from the Association or the relevant rights holders, Users may not copy, reproduce, modify, distribute, display, perform, publish, license, create derivative works from, transfer, or sell any Website Content in any manner. The Association grants Users a limited, non-exclusive, non-transferable, revocable license to access and use this website and its services solely for personal, non-commercial purposes, strictly in accordance with these Terms.

For any content (such as comments, articles, suggestions, etc.) that Users post or submit on this website, unless otherwise agreed in writing, Users grant the Association a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content to the extent reasonably necessary for the Association to promote its mission and objectives. Users warrant that any content they submit does not infringe upon any third-party rights.

4. Disclaimers and Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THIS WEBSITE AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE ASSOCIATION MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES REGARDING THE OPERATION OF THE WEBSITE, THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF INFORMATION, THE DEPENDABILITY OF CONTENT, THE AVAILABILITY OR UNINTERRUPTED NATURE OF SERVICES, OR THAT ERRORS WILL BE CORRECTED. THE ASSOCIATION DOES NOT WARRANT THAT THE WEBSITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

ALL INFORMATION, OPINIONS, AND ADVICE PROVIDED BY THE ASSOCIATION (INCLUDING BUT NOT LIMITED TO CONTENT RELATED TO FENG SHUI AND I CHING STUDIES) ARE FOR INFORMATIONAL, EDUCATIONAL, AND ACADEMIC EXCHANGE PURPOSES ONLY AND DO NOT CONSTITUTE PROFESSIONAL INVESTMENT, MEDICAL, LEGAL, OR OTHER SPECIALIZED ADVICE OR A BASIS FOR DECISION-MAKING. USERS SHOULD EXERCISE THEIR OWN INDEPENDENT JUDGMENT AND DUE DILIGENCE, AND CONSULT WITH QUALIFIED PROFESSIONALS WHERE NECESSARY. ANY DECISIONS MADE OR ACTIONS TAKEN IN RELIANCE ON INFORMATION FROM THIS WEBSITE ARE AT THE USER'S SOLE RISK.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL THE ASSOCIATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, ETC.) ARISING FROM THE USE OR INABILITY TO USE THIS WEBSITE OR ITS SERVICES, WHETHER SUCH LIABILITY IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF THE ASSOCIATION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. ACCORDINGLY, IF THE LAWS OF THE USER'S JURISDICTION CONFLICT HEREWITH, SOME OF THE ABOVE DISCLAIMERS AND LIMITATIONS OF LIABILITY MAY NOT FULLY APPLY TO SUCH USER, IN WHICH CASE THE ASSOCIATION'S LIABILITY WILL BE LIMITED TO THE MINIMUM EXTENT PERMITTED BY APPLICABLE LAW.

5. Third-Party Links and Services

This website may contain links to websites or resources owned or operated by third parties. These links are provided solely for User convenience. The Association has no control over and assumes no responsibility for the content, privacy policies, or practices of such third-party websites, nor does it endorse or guarantee their accuracy or reliability. Any interaction by the User with third-party websites (including, without limitation, the purchase and payment for goods or services) is solely between the User and such third party. Users access and use any third-party websites at their own risk and are subject to the terms of service and privacy policies of such third-party websites.

6. Modification of Terms

The Association reserves the right, at its sole discretion, to modify or replace any part of these Terms of Service at any time. Any modifications will become effective thirty (30) days after being posted on this website, or upon such reasonable notice to Users as the Association may provide through other means (such as email). The Association encourages Users to periodically review these Terms for any changes. Continued access or use of this website or its services by the User after any modifications to these Terms become effective constitutes acceptance of and agreement to be bound by such modified Terms.

7. Governing Law and Dispute Resolution

These Terms, their subject matter, and their formation, and any non-contractual disputes or claims arising out of or in connection with them or their subject matter or formation, are governed by and shall be construed in accordance with the laws of the Province of [Insert Province of Registration, e.g., Ontario], Canada, and the federal laws of Canada applicable therein, without regard to its conflict of law principles.

The parties agree that any dispute, claim, or controversy arising out of or relating to these Terms shall first be addressed by good faith negotiation between the parties. If the dispute is not resolved through negotiation within thirty (30) days of one party notifying the other in writing of the dispute, then either party may submit such dispute to the exclusive jurisdiction of the competent courts located in [Insert City and Province of Registration, e.g., Toronto, Ontario], Canada. The parties hereby irrevocably consent to and accept the exclusive jurisdiction and venue of such courts.

Notwithstanding the foregoing, the Association reserves the right to seek injunctive relief (or an equivalent type of urgent legal relief) in any court of competent jurisdiction to protect its intellectual property rights or confidential information.

The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms.

8. Severability and Waiver

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be limited or severed to the minimum extent necessary so that the remaining provisions of these Terms shall continue in full force and effect.

No failure or delay by the Association in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or privilege preclude any other or further exercise thereof or the exercise of any other right, power, or privilege.

9. Entire Agreement

These Terms, together with any policies or operating rules incorporated herein by reference (such as the Privacy Policy), constitute the entire agreement and understanding between the User and the Association with respect to the use of the website and services, and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between the parties.

10. Language

These Terms have been drafted in English and Chinese. In the event of any inconsistency or ambiguity between the English and Chinese versions, the English version shall prevail in interpretation, unless otherwise mandated by applicable law. (Note: If only one language version is provided, or if a specific language version is designated to prevail, please amend this clause accordingly.)
